These Terms of Service ("Terms") form a binding agreement between you and HighPex Hosting ("HighPex", "we", "us") covering your access to and use of our websites, billing panel, and hosting services. By creating an account or placing an order, you confirm that you have read, understood, and agreed to these Terms.
By registering an account, submitting an order, or using any HighPex service, you agree to these Terms together with our Privacy Policy and Refund Policy, which are incorporated here by reference.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
Orders are typically provisioned automatically once payment is confirmed. Some services require manual review and may be activated after verification by our team.
You agree not to use HighPex services to host, transmit, or facilitate any of the following:
Violations may result in immediate suspension without refund, and where required, referral to law enforcement.
Shared environments depend on fair use. If a site or application consumes resources in a way that degrades performance for other users, we may throttle it, request optimisation, or ask you to move to a larger plan.
Where a plan is advertised as "unlimited" in a given dimension, that refers to the absence of a hard quota under normal website use, not to unrestricted consumption of server capacity.
We target high availability across our infrastructure and publish incident information on our status page. Scheduled maintenance is announced in advance where practical; emergency maintenance may occur without notice.
Support is provided through tickets in your billing panel. Support covers our infrastructure and platform. Assistance with third-party application code, custom scripts, or website development is offered on a best-effort basis.
We may suspend or terminate a service where:
You may cancel a service at any time from your billing panel. Cancellation takes effect at the end of the current billing period unless you request immediate termination.
Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, HighPex is not liable for indirect, incidental, or consequential losses, including lost profits, lost revenue, or lost data.
Where liability cannot be excluded, our total aggregate liability is limited to the amount you paid for the affected service during the three months preceding the claim.
We may update these Terms to reflect changes in our services, operations, or legal obligations. The "last updated" date at the top of this page shows when the current version took effect. Material changes will be communicated by email or through your billing panel.
Continued use of our services after a change takes effect constitutes acceptance of the revised Terms.
